Basic Terminology:

The Alpha Hospitality is a company that provides villas, bungalows, farmhouses, homestays, service apartments, and/or their rooms to guests, mainly for residential purposes to the guest, under the brand name “The Alpha Hospitality”. The below Terms and Conditions apply to all the guests or customers who make bookings for any of the Properties (defined below) or their rooms through our website, our mobile application, third-party websites or third-party applications, or through any travel agents/third parties/ advertisements/ referrals, etc. (collectively “Booking Channels”). All guests should ensure to read and understand all the Terms and Conditions stated on our website before using this website and making a booking through any of the Booking Channels. These Terms and Conditions shall apply to guests making a booking through any of the Booking Channels. If you are not agreeable to any of these Terms and Conditions of Use, please do not use this website/Booking Channels and do not make a Booking for any of the Properties. These Terms and Conditions are subject to change and The Alpha Hospitality may at any time, without prior notice to you/ any guest, revise them and any other information contained in this website and/or any Booking Channel by updating these Terms and Conditions. Please note that the restated Terms and Conditions shall be effective immediately upon posting. The Alpha Hospitality may also make improvements or changes in the services provided by it as described in this website/ Booking Channels at any time without notice. Therefore, you are advised to regularly check for any amendments or updates to these Terms and Conditions. If the changes are not agreeable to you, you must stop using the website. Your continuous use of this website will imply your acceptance of the changed terms.

Except where additional terms and conditions are provided, these Terms and Conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order placed or service provided by The Alpha Hospitality.

For online as well as offline bookings made through our platform, the terms used in these Terms and Conditions have the following meaning:

(a) “Property/Properties” shall mean and include villas, bungalows, farmhouses & homestays, service apartments, and/or their rooms available for booking on any of the Booking Channels.

(b) “Guest/Guests” refers to any individuals/ companies or other entities who express interest in making a booking in respect of any of the Properties through any Booking Channels. Guests may be referred to as you if you're in a given context.

(c) “Booking” means a reservation made by any Guest in respect of any of the Properties for stay.

(d) "Check-In" is the scheduled date and time on or before which the Guest shall be liable to comply with all the check-in formalities as required by Vista and after completion of such formalities, the Guest shall be entitled to start using the concerned property.

(e) "Check-Out” is the scheduled date and time on which the Guest will have to vacate the concerned Property after completion of all the check-out formalities as required by Vista.

(f) “Booking Period” is the period between which the scheduled Check-In starts and the scheduled Check-Out ends

(g)  “Booking Amount” shall mean the total amount payable by the Guest to The Alpha Hospitality for confirmation of the Booking through the registered mode of payment, as may be intimated by The Alpha Hospitality to the Guest.

(h) “Booking Confirmation” shall mean the email/communication shared by The Alpha Hospitality with the Guests upon receipt of the Advance (defined below) and shall comprise all the details of the Booking, Terms and conditions governing the Booking, name, and total number of Guests, Check-In and Check-Out details, name of Property, number of rooms at the Property, the Booking Amount payable and Security Deposit amount payable and specified due dates by which they are required to be paid/deposited. The Alpha Hospitality shall not be liable to serve a Booking unless the entire Booking Amount is paid by the Guest/Guests to The Alpha Hospitality through the registered mode of payment intimated by The Alpha Hospitality to the Guest as stated herein, even though the Booking Confirmation may have been sent to the Guest. The Booking Confirmation along with proof of payment of the entire Booking Amount shall be required to be produced by Guests at the Property at the time of Check-In.

(i) "Advance" is the non-refundable amount required to be deposited by Guests with The Alpha Hospitality as a deposit for putting a Booking on Hold (as stated hereinbelow) in respect of a Property.

(j) "Security Deposit" is the amount required to be deposited by Guests on a case-to-case basis with The Alpha Hospitality. The Security Deposit shall be utilized by The Alpha Hospitality for any damages caused by the Guests/their pets to the Property and/or items/furniture therein and/or for recovery of any other charges levied by The Alpha Hospitality on Guests.

(k) “Peak Days” include long weekends, and festive dates including but not limited to Diwali, New Year's, Christmas, etc.

 

Acknowledgment and Express Consent:

Your use of this website is subject to the Terms and Conditions of Use mentioned herein along with the Privacy Policy and all other policies listed on The Alpha Hospitality’s website. The terms and conditions contained on The Alpha Hospitality’s website herein, form a binding agreement between yourself and The Alpha Hospitality concerning the use of this website and the services hereunder, by you. By accessing, viewing, browsing, caching, storing, and/or otherwise using our website or any of our services, applications, contents, or functions through whatever platform and/or by completing a Booking, you acknowledge and agree to have read, understood and agreed to all the terms and conditions set out on the website (including the Privacy Policy) and agree to be bound by them.

These pages, the content and infrastructure of these pages, and the online accommodations reservation service provided on these pages and through the website (“the Service/s") are owned, operated, and provided by www.thealphahospitality.com and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.

 

Eligibility:

Use of our Booking Channels for making a Booking in respect of a Property is available only to persons who can enter into legally binding contracts under the Indian Contract Act, of 1872. Persons who are ‘incompetent to contract' within the meaning of the Indian Contract Act, 1872 are not eligible to use our Booking Channels to make a Booking in respect of a Property.

 

Access and Interference of booking made through online platform:

The Alpha Hospitality grants you non-exclusive and non-transferable, limited permission to access and display the web pages within this website on your personal computer or other platform. Your failure to comply with the terms, conditions, and notices on this website will result in the automatic termination of any rights granted to you, without prior notice. Except for the limited permission in the preceding paragraph, The Alpha Hospitality does not grant you any express or implied rights or licenses under any patents, trademarks, copyrights, or other proprietary or intellectual property rights. You may not copy any of the content from this website onto another website or in any other media. You hereby agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of this website or any transaction being conducted via this website. You hereby confirm that no copying, reproduction, alteration, modification, creation of derivative works, or publicly displaying of any content will be done by you except with our prior written consent.

The information you provide to us shall not contain any viruses, including but not limited to, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data or information.

 

Description of services provided by The Alpha Hospitality:

The Alpha Hospitality serves as an online as well as offline platform for booking Properties at affordable prices. The Alpha Hospitality also hosts content about the Properties. The inclusion of any amenities or services at the Properties at a particular time shall not imply or warrant that these amenities or services will be available at all times and The Alpha Hospitality reserves the right to discontinue them at any time.

 

Accuracy of Content:

The Alpha Hospitality has taken every precaution in the preparation of the content of Booking Channels, website, and mobile applications in particular to ensure that rates quoted are correct at the time of publishing and all details have been accurately displayed. You understand and agree that The Alpha Hospitality shall not be liable for any typographical, technical, or any other kind of errors on the Booking Channels.

 

Additional Services:

To provide complete comfort to the Guests, The Alpha Hospitality may at its sole discretion and subject to availability arrange additional services like chef, cleaners, vehicle hire, etc. by outsourcing such services from third-party vendors on prior request of Guests.

Guests shall understand and agree that such services may not be part of the Booking Amount/ Advance/ Security Deposit paid by the Guests and such services may accrue additional charges. These additional services are provided by The Alpha Hospitality solely for the convenience of Guests without any commitment or obligation of any kind whatsoever on the part of The Alpha Hospitality.

 

 

Pricing:

The tariffs mentioned by The Alpha Hospitality Booking Channels are non-negotiable and are subject to change without prior notice. All rates mentioned by The Alpha Hospitality Booking Channels are as per room and/or as per multiple rooms basis. The tariff for the Properties may or may not include applicable taxes (if any) depending on the type of Property. The tariffs mentioned on any online booking channels may be inaccurate due to a technical glitch. If such a technical glitch error occurs which is beyond the control of The Alpha Hospitality, The Alpha Hospitality reserves the right to correct the same and the incorrect tariff will not be enforceable against The Alpha Hospitality.

 

Right of Admission and Possession of the Property:

In case of any Booking, it is understood and accepted by all the Guests that they shall never be in possession or have a charge or claim to have any of the Properties booked by him or her at any time whatsoever.

The Guests shall not be allowed to check in on the Property before or at the time of Check-In unless they comply with all the requirements as prescribed. In case the Guests do not comply with the prescribed requirements, no refund against the Booking Amount/ Deposit paid by Guests or compensation of any kind of whatsoever nature or amount shall be claimable by Guests or due or payable by The Alpha Hospitality to the Guests or anyone else.

 

 (a) Guests must provide Booking Confirmation issued by The Alpha Hospitality along with the proof/details of payment of the entire Booking Amount.

 (b) In compliance with the Government security regulations, every Guest, coming to stay at the Properties, would be mandatorily required to provide original government-issued photo IDs for verification as well as a copy of the photo IDs, on or before check-in.

 (c) Guests shall enter the name, address, and other details of all the guests, including children, in the Guest Register kept at respective Properties and/ or maintained digitally.

In case any guest has provided incorrect and false information at the time of Booking, The Alpha Hospitality shall be entitled to forthwith revoke the Booking, and refuse entry to the Property and if the Guests have already Checked-In, then they shall be evicted from the Property by any of the representatives of The Alpha Hospitality. In such cases the Deposits/ Booking Amount paid by the Guests shall not be refunded nor shall any compensation of any kind or nature be paid by The Alpha Hospitality to the Guest.

At the time of Check-In or during the stay, the total number of Guests along with visitors the Guests shall not exceed the number stated at the time of making the Booking. The Alpha Hospitality may permit, at its sole discretion, additional persons to stay at the Property, at an additional cost. No additional persons will be allowed unless a written acceptance is issued by The Alpha Hospitality.

 

Our Charges:

The Alpha Hospitality reserves the right to charge and add any additional (reservation or facilitation) fees without any prior notice to the Guests.

 

Terms of Use:

While using this website, you acknowledge that you fully assume the risks of the transaction and you further fully assume the risks of liability or harm of any kind in connection with subsequent activity of any kind relating to the accommodation that is the subject of the transaction(s).

 

Link to another website:

The website may contain links to other third-party websites and web pages. The Alpha Hospitality does not in any manner represent or endorse such websites/webpages and is not liable for the contents of such websites or for any claims arising out of your use of these websites as The Alpha Hospitality has no control over such websites in any manner whatsoever.

 

Promotional Offers:

Once you share your contact details on the website, you agree to opt-in to receive promotional content from The Alpha Hospitality on WhatsApp, email, push notifications, and SMS. The Alpha Hospitality may provide you with various discounts and offers from time to time. Any such discounts, offers, or promotional schemes will be subjected to specific terms and conditions listed on the website, which may vary from time to time. The Alpha Hospitality reserves the right to alter or withdraw any promotional scheme at any time without any prior notice.

 

Booking Confirmation:

Guests shall understand and agree that making payment of the Advance and/or Security Deposit (depending on case to case basis as decided by The Alpha Hospitality) or Booking Confirmation shall construe and mean that Guests have read and unconditionally accepted all the details of the Booking and abide by them.

The issuance of the Booking Confirmation does not ensure that Booking is confirmed.

It is clarified that The Alpha Hospitality shall not be liable to serve a Booking unless the entire Booking Amount is paid by the Guest/Guests to The Alpha Hospitality through the registered mode of payment intimated by The Alpha Hospitality to the Guest/ Guests even though the Booking Confirmation may have been sent to the Guest. The Booking Confirmation shall stand canceled, withdrawn, and null and void if the entire Booking Amount is not received by The Alpha Hospitality by specified due dates.

In the event a Booking is made from any third-party websites or third-party applications or through any travel agents/third parties/ advertisements/ referrals, the Guest/Guests should confirm the Booking with us. The Alpha Hospitality shall not be liable to serve a Booking unless the entire Booking Amount is received by The Alpha Hospitality through the registered mode of payment, even though the Booking Confirmation may have been sent to the Guest by such third-party websites or third-party applications or through any travel agents/third parties/ advertisements/ referrals and/or The Alpha Hospitality. Further, in the event a Booking is made from any third-party websites or third-party applications or through any travel agents/third parties/ advertisements/ referrals, the terms and conditions of such third party shall also apply to the Guest/Guest and the Booking, in addition to the terms and conditions laid down by us in respect to the Booking. In the event any term/condition of such third party is inconsistent with the Terms and Conditions set out herein or intimated to the Guest/Guests by The Alpha Hospitality, the Terms and Conditions of The Alpha Hospitality shall prevail.

 

 

Booking on Hold:

Upon receipt of the amounts towards Advance & Security Deposit, The Alpha Hospitality shall put the Booking in “Booking on Hold” status. The Booking will be served by The Alpha Hospitality only upon receipt of the entire Booking Amount through the registered mode of payment, intimated by The Alpha Hospitality to the Guest/ Guests. If the entire Booking Amount is not received by The Alpha Hospitality by the specified due date and through the registered mode of payment intimated by The Alpha Hospitality to the Guest/ Guests, Vista shall not be liable to serve the Booking.

 

Check-in and Check-out Timings:

Check-In and Check-out Time shall be as specified in relevant Booking Confirmation. The Alpha Hospitality recommends and encourages Guests not to arrive at the Property before stated Check-In time as it would be difficult to accommodate the Guests arriving before Check-In time. If Guests reach and enter the Property before the Check-In time mentioned in the Booking Confirmation, the Guests may be charged an additional amount, as may be decided by The Alpha Hospitality.

If an alternate Check-Out time is approved by The Alpha Hospitality, it shall be intimated in writing by The Alpha Hospitality. Guests shall not occupy or stay at the Property beyond the Check-Out time stated in the Booking Confirmation. If the Guests occupy the Property after the stipulated Check-Out time, the Guests may be charged an additional amount, as may be decided by The Alpha Hospitality.

 

Payment of Advance/ Security Deposit by Guest and Damage to Property:

For reserving the Booking, Guests will have to pay the Advance before receiving the Booking Confirmation, as a security, to protect The Alpha Hospitality against the loss of revenue in case a Guest cancels a Booking or does not pay the balance amount.

In the event the Advance is not received by The Alpha Hospitality, the Booking Confirmation shall not be sent by The Alpha Hospitality to the Guest.

The Guests shall be responsible for checking and reporting any damage to the Property or the equipment, appliances, cutlery, crockery, utensils, furniture, fittings, furnishing, finishing, structure, etc. therein within 90 minutes of Check-In. If the Guest fails to/ does not report any damages during the aforesaid period, such damage shall be deemed to have occurred during the stay of the Guest and the Guest shall be responsible to reimburse to The Alpha Hospitality for any such damage without demure and delay.

Guests shall use the Property and the items/furniture therein with utmost care. At the time of Check-Out, the Guest shall leave the Property in good order and reasonably clean condition except for normal usage.

The Guests agree and understand that in case any damage or breakage is caused to a single item forming a set unless an identical replacement can be found the Guest shall be liable to pay for the replacement of the entire set. e.g. If a glass in a set of 6 glasses is broken/chipped, the Guest shall be responsible for paying for the replacement of all 6 pieces of the set.

Without prior consent of The Alpha Hospitality Guests shall not move or relocate any equipment, appliances, furniture, fittings, furnishing, finishing artifacts, etc. from their original location except for chairs, other furniture like cane/plastic furniture, etc.

The Guests understand and agree that The Alpha Hospitality cannot immediately inspect the Property for damages at the Check-Out time of the Guests as there may be multiple rooms and facilities to be inspected. The inspection for damages shall be done by The Alpha Hospitality in the intervening time between one guest check-out and the next Check-In. Thus, refunding of Security Deposit after adjusting the amount recoverable from the Guests, if any, cannot be done immediately upon Check-Out. The Alpha Hospitality shall make an effort to refund the Security Deposit or the balance Security Deposit, as the case may be, maximum within 30 days from the date of Check-Out. After the inspection, the assessed cost of repairs/replacement shall be communicated to Guests for their information and the same shall be final and binding on Guests.

If the amount of repair/ replacement of items, equipment, appliances, furniture, fittings, furnishing, artifacts, etc. exceeds the amount of the Security Deposit, the excess amount shall be intimated to the Guests in writing and the Guests shall be liable to pay the same, without demure, within 7 days of such demand being made by The Alpha Hospitality. Any refund due against the Security Deposit shall be made through a cheque or bank transfer in favor of the Guests as per the account details provided by the Guests or in the mode in which the Guests had made payment.

 

Payment Options:

The various registered modes of payment permitted by The Alpha Hospitality are as follows:

Credit Card/Debit Card.

Payments may be made using credit cards, debit cards, or any other card including but not limited to Visa, MasterCard, RuPay, and American Express as mentioned in the Booking Channels from time to time.

Net banking

You may also avail your bank's internet banking services to make payments on this website. Any charge levied by banks or payment gateway is independent and has no connection with The Alpha Hospitality. The Alpha Hospitality shall have no liability in case of any charge levied by banks or payment gateways.

In case the payment of any amount due and payable by the Guest/Guests to The Alpha Hospitality is not made to The Alpha Hospitality, The Alpha Hospitality shall not be entitled to serve the Booking.

 

Financial Details:

You agree, understand, and confirm that the credit/ debit card details or other financial details provided by you will be correct and accurate and you shall not use the credit/ debit card or financial facility which is not lawfully owned/ obtained by you. The Alpha Hospitality will not be liable for any credit/ debit card fraud. The liability for use of a card fraudulently will be on you and the onus to prove otherwise will be exclusively on you.

 

Pets Policy:

Pets may or may not be allowed on the Properties at the discretion of The Alpha Hospitality. Such information will be set out in the Booking Confirmation issued to Guests. The Alpha Hospitality may, at its discretion, charge a non-refundable Pet Fee. If the Guests/their visitors, bring pets to the Property without The Alpha Hospitality's prior written approval or if the Guests bring pets other than the one whose specific approval is granted, such pets shall not be allowed to enter the Property and if Guests have already Checked-In, they may be evicted by The Alpha Hospitality from the Property.

Pets, when allowed by The Alpha Hospitality, must be kept on the Property and should always be in the company and control of Guests. Guests shall be solely and entirely responsible for ensuring that pets do not soil, spoil, or damage the Property and/or the items/furniture therein. The Guests shall be responsible for ensuring that their pets do not create any nuisance to the neighbors or any other people around the Property.

Specific and General Breach:

Breach of any of the terms and conditions stated herein shall result in automatic and immediate termination of the Booking and will also result in immediate eviction/removal of Guests from the Property and immediate forfeiture of the entire Booking Amount or any other amounts paid by Guests without recourse whatsoever to any refund of amounts paid or deposited by the Guest/Guests.

 

Cancellation and Refunds:

The Alpha Hospitality shall be entitled to cancel a Booking at any time without giving any prior intimation to the Guest/Guests. To see our updated Cancellation Policy, please visit the Cancellation Policy.

 

Safety and Prohibition:

a. Guests shall understand and agree that the Property booked by the Guests is a residential property with other persons living around. The conduct of the Guests must in no way disturb the tranquility, peace, and modesty of the neighbors.

b. The Property booked by the Guests shall be used only for the stay and not for any other purpose.

c. The Guests shall not cause any nuisance to the property of the neighbors.

d. To avoid disturbance to the neighbors the Guest shall ensure that no loud music is played around the poolside, garden, compound, balconies or terraces, etc., or any outdoor area that would cause disturbance to neighbors or cause any kind of nuisance.

e. The Guests shall not use Property for committing or conducting any unlawful act or immoral activity, The Alpha Hospitality and any of the representatives, employees, relatives, or agents of The Alpha Hospitality shall in no way be responsible or liable for such acts on behalf of the Guests.

g. The Guests shall not possess or consume any prohibited drugs or organize any rave parties in or around the Property. Breach of this condition will result in the immediate lodging of a Police Complaint by The Alpha Hospitality against the Guests.

 

Confidential and Personal Data/Information:

Any information that is required to be collected by us shall be kept confidential by the provisions of our Privacy Policy. In addition to the same, the provisions of the following laws/ rules/ guidelines/ regulations shall apply to the use of our Online Booking Channels:

i. The provisions of the Information Technology Act, 2000 relating to the processing of personal data and as may be amended from time to time;

ii. The provisions of the Information Technology (Intermediary Guidelines) Rules, 2011 as may be amended from time to time;

iii. The provisions of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 may be amended from time to time.

Any information provided by you in case of any Booking made through our Offline Booking Channels shall also be kept confidential as per these Terms and Conditions.

 

Intellectual Property Rights:

Unless stated otherwise, the software required for our services or available on or used by our Online Booking Channels and all intellectual property of the contents and information of and material on our Booking Channels are wholly and exclusively owned by and all rights, title, and interest solely vest in The Alpha Hospitality. Intellectual Property shall include but not be limited to all developments, proprietary information, trademarks, trade names, logos, artwork, slogans, service marks, domain names, brand names, know-how, processes, methods, trade secrets, designs, and all other work in which copyright may subsist.

You are not entitled to copy, scrape, (hyper-/deep) link to, publish, promote, market, integrate, utilize, combine, or otherwise use the content or our brand. To the extent that you would (wholly or partly) use or combine our content or would otherwise own any Intellectual Property Rights in the Online Booking Channels, you hereby irrevocably and unequivocally assign, transfer, and set over all such Intellectual Property Rights to www.thealphahospitality.com.

Any unlawful use or any of the aforementioned actions or behavior will constitute a material infringement of our Intellectual Property Rights.

 

Limitation of Liability:

The Guests understand and agree that The Alpha Hospitality is only an online and offline booking platform and The Alpha Hospitality shall have no liability in the following situations and/or in any other similar situations:

a) In case of any accidents, fire, hazard, injuries or death(s) caused due to any reasons including but not limited to fights/ quarrels between two or more Guests or between Guests and caretaker of the Property or any other emergencies at the Property caused by or to the Guests, caretaker or any third party.

b) If any illegal or hazardous activities are committed by the Guests or any other person accompanying the Guests at the Property, The Alpha Hospitality shall be not liable for any consequences arising from such activities.

c) In case of any criminal acts including but not limited to discrimination against or harassing anyone based on race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation, or otherwise engaging in any abusive or disruptive behavior, theft, murder, kidnapping, criminal negligence, indulging in narcotics, prostitution, rave party, obscene acts committed by or to the Guest, any person accompanying Guest, caretaker, or any third party.

d) The Alpha Hospitality shall not be liable for any kind of structural damages, cracks on the walls, leakages, seepage, or any issues related to paintwork, electronic devices in the Property, swimming pool, windows, doors, etc.

Any claims of damages by the Guests or their property should be immediately reported to The Alpha Hospitality and should be claimed before the Check Out. The Alpha Hospitality shall not be responsible for any claim of damages or any liability, reported after the Check Out that may be caused to the Guests.

The liability of The Alpha Hospitality in case of any damage caused to the Guest or any person accompanying the Guest about the services provided at the Property (if found to be justifiable to have occurred on behalf of The Alpha Hospitality) shall be limited to and not in any case exceed the Booking Amount paid the Guest. The final decision regarding the claim of damage by the Guests shall be of The Alpha Hospitality.

 

Guest Issues:

The Guests understand and agree that The Alpha Hospitality is only an online and offline booking platform and The Alpha Hospitality shall have no liability in the following situations and/or in any other similar situations:

a) In case of any accidents, fire, hazard, injuries or death(s) caused due to any reasons including but not limited to fights/ quarrels between two or more Guests or between Guests and caretaker of the Property or any other emergencies at the Property caused by or to the Guests, caretaker or any third party.

b) If any illegal or hazardous activities are committed by the Guests or any other person accompanying the Guests at the Property, The Alpha Hospitality shall be not liable for any consequences arising from such activities.

c) In case of any criminal acts including but not limited to discrimination against or harassing anyone based on race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation, or otherwise engaging in any abusive or disruptive behavior, theft, murder, kidnapping, criminal negligence, indulging in narcotics, prostitution, rave party, obscene acts committed by or to the Guest, any person accompanying Guest, caretaker, or any third party.

d) The Alpha Hospitality shall not be liable for any kind of structural damages, cracks on the walls, leakages, seepage, or any issues related to paintwork, electronic devices in the Property, swimming pool, windows, doors, etc.

Any claims of damages by the Guests or their property should be immediately reported to The Alpha Hospitality and should be claimed before the Check Out. The Alpha Hospitality shall not be responsible for any claim of damages or any liability, reported after the Check Out that may be caused to the Guests.

The liability of The Alpha Hospitality in case of any damage caused to the Guest or any person accompanying the Guest about the services provided at the Property (if found to be justifiable to have occurred on behalf of The Alpha Hospitality) shall be limited to and not in any case exceed the Booking Amount paid the Guest. The final decision regarding the claim of damage by the Guests shall be of The Alpha Hospitality.

 

Force Majeure:

You understand and agree that The Alpha Hospitality will not be liable for any loss or damage caused during the Booking and/or concerning the use of this website and/or making any reservations if the same arises out of Force Majeure Event. Force Majeure Event shall mean any acts, events, or accidents beyond the control of The Alpha Hospitality, including but not limited to strikes, lock-outs, or other industrial disputes (whether involving the workforce of the company or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, earthquake, compliance with any law or governmental order, rule or regulation, accident, breakdown of plant or machinery, fire, flood, storm, epidemic, pandemic, etc.

 

Termination:

You understand and agree that The Alpha Hospitality reserves the right to terminate your registration and/or terminate your right to use this website for any reason whatsoever, including without limitation, any act or omission in contravention of the Privacy Policy or of these Terms and Conditions of Use. You further understand and agree that any such termination may be effected without prior notice to you and you acknowledge and agree that The Alpha Hospitality may delete or deactivate your account immediately upon detecting any such reason, including without limitation, the contravention of the Privacy Policy or these Terms and Conditions of Use.

 

Dispute Resolution and Applicable Law and Jurisdiction:

Any disputes, claims, or differences with regards to the Booking or in respect of any matters arising out of the Booking, shall be referred to arbitration of a sole arbitrator, whose decision shall be final and binding. The sole arbitrator shall be mutually appointed by the Parties. The Arbitration shall be held at Pune and shall be governed by the provisions of the Indian Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration proceeding shall be conducted in English. Subject to the above arbitration provisions, the competent Courts in Pune shall have the jurisdiction in the matter.

 

Assignment:

Any Bookings made by the Guests are not assignable.

 

Notices:

Any notices or other communications to be sent by The Alpha Hospitality to the Guests shall be in writing and shall be sent by The Alpha Hospitality (i) via email (in each case to the address that the Guest provides) or (ii) by posting to the Site or via the Application. For notices/communications sent by e-mail, the date of receipt will be deemed the date on which such email is transmitted.

 

Indemnification:

By making a Booking, you assure and represent that the same has been made for private/residential and personal use and not for commercial purposes or any other purpose. You expressly indemnify The Alpha Hospitality and agree to keep The Alpha Hospitality fully and effectively indemnified, saved, defended, and held harmless, from any loss or damage suffered by you on account of breach of the aforesaid assurance, including without limitation, any loss of profits, indirect loss, consequential loss, loss of income, damage to property, loss of reputation, etc.

Guests agree to indemnify and keep fully and effectively indemnified, saved, defended, and hold harmless, The Alpha Hospitality, its affiliates, contractors, employees, officers, directors, and agents, from and against any claims, losses, damages, and liabilities, costs and expenses, including without limitation to legal fees and expenses, arising out of or related to Guest use or misuse of the services or our Booking Channels, any violation by you of the Terms and Conditions mentioned on this website, or any breach of the representations, warranties, and covenants made by Guests herein.

 

Feedback:

The Alpha Hospitality encourages you to provide feedback, comments, and suggestions for improvements to the Site, Application, and Services ("Feedback"). Submission of Feedback may be made by emailing us at response@thealphahospitality.com.

 

Waiver:

The failure of The Alpha Hospitality to exercise or enforce any right or provision of the Terms and Conditions mentioned on this website will not constitute a waiver of such right or provision.

 

Grievance Redressal:

The Alpha Hospitality makes its best efforts to provide the best quality of services. However, if any person has any grievance concerning any aspect/feature of the website, you may write to response@thealphahospitality.com. All grievances shall be dealt with as soon as possible.

 

Submission:

Any messages, notes, suggestions, ideas, notes, drawings, concepts, or other material or information (collectively, the “Submissions”), that you may submit through or in connection with this website will become the exclusive property of The Alpha Hospitality. Accordingly, you agree that we have the right to publish any Submissions for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Submissions. In addition, you agree that you will not transmit any Submission which infringes upon the rights of any third party. In case of any damage or injury to anyone by your submissions, you admit your liability and release The Alpha Hospitality from any responsibility.

 

Miscellaneous:

This website shall have the right to assign its obligations and duties as mentioned herein and in any agreement relating to any or all of its services to any person or entity.
